ADA Complaint Procedure


ARCH strives to comply with Title II of the Americans with Disabilities Act of 1990.

ARCH makes it a priority to ensure equal access to programs, services, benefits, activities, transportation seating and treatment for all individuals attending program or utilizing services offered by ARCH. No individual receiving services through ARCH will be subjected to discrimination under the rules of Title II of the Americans with Disabilities Act of 1990 (as amended).

What is Title II

Title II of the Americans with Disabilities Act of 1990 (as amended) protects all individuals from being denied service or being discriminated against by any public entity, including public transit. ARCH is committed to complying with the requirements of Title II of the ADA in all of its programs, services, benefits and activities.

How Do I File a Complaint?

ARCH wants all individuals utilizing services to do so freely and with confidence. If anyone feels they’ve been discriminated against by being denied service or related reasons by ARCH or its employees may file a complaint with ARCH Administration within 180 days of the alleged incident.

Any complainant dissatisfied with ARCH’s decision may file a complaint directly with the City of Phoenix or with the Federal Transit Administration (FTA) within the 180-day timeframe.

Complaints received by ARCH will be assigned to appropriate staff member(s) for investigation. After the complaint is processed, ARCH will respond to the complaint within a reasonable time and, if warranted by the investigation, will initiate appropriate action. The City of Phoenix, as the designated recipient of federal funds for this region, is responsible for monitoring this process.
